Terms of Service Private Beta

These Terms govern your access to and use of StrokeX (the "Service"), including the app, website/portal, and any related device firmware features.

StrokeX is a private, invite-only beta operated by an individual developer ("Operator"). Accounts are manually created for selected testers.

By using the Service, you agree to these Terms and the Privacy Policy.

1. Beta / Experimental Status

The Service is experimental and provided for testing and evaluation. You understand that:

Features may change or be removed
Outages may occur
Data loss is possible
The Service may be discontinued at any time

2. Eligibility

You must be 18 years or older to use the Service.

3. Accounts and Access

Accounts are invite-only and created by the Operator. There is no public registration.
You must keep your login credentials confidential.
You are responsible for activity under your account.
Notify us promptly if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

Use the Service for illegal purposes
Attempt to bypass security or access others' data
Disrupt the Service (e.g., abuse, scraping, automated attacks)
Reverse engineer, decompile, or attempt to extract source code or proprietary algorithms except to the extent such restriction is prohibited by law
Redistribute or resell the Service, portal access, or training data access without written permission

5. Training Data, Ownership, and License

5.1 Your Data

You retain ownership of your raw swing/sensor data you submit.

5.2 License You Grant to the Operator (Training Mode)

If you enable Training Mode or otherwise provide training sensor data, you grant the Operator a non-exclusive, worldwide, royalty-free license to:

Use, reproduce, analyze, transform, and create derivative works from the data
For the purpose of improving, testing, and developing swing analysis algorithms and related features

Where feasible, the Operator will use de-identified/pseudonymous training data for model improvement.

5.3 Derived Artifacts

You acknowledge that the Service may create derived artifacts (e.g., model weights, aggregated datasets, algorithm improvements). Even if you later request deletion, those derived artifacts may not be practically reversible to remove your specific contribution.

6. Feedback

If you provide feedback or suggestions, you grant the Operator permission to use them without restriction or compensation.

7. Hardware and Safety

If you use any sensor hardware or attach devices to golf equipment:

Use at your own risk and follow basic safety precautions.
Do not use modified/damaged equipment.
The Service provides experimental analysis and is not a substitute for professional coaching, medical advice, or safety training.
You acknowledge golf is a physical activity with inherent risks and you assume all risks arising from your use of the Service and related hardware.

8. Third-Party Services

The Service may rely on third-party infrastructure (e.g., hosting/storage providers). The Operator is not responsible for third-party outages or acts outside the Operator's reasonable control.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

To the maximum extent permitted by law, the Operator disclaims all warranties, express or implied, including:

Accuracy or reliability of analysis
Fitness for a particular purpose
Uninterrupted or error-free operation
Non-infringement

10. Limitation of Liability

To the maximum extent permitted by law:

The Operator will not be liable for indirect, incidental, consequential, special, or punitive damages.
The Operator will not be liable for loss of data, profits, goodwill, or business interruption.
The Operator's total liability for any claim will not exceed the greater of (a) $100 USD or (b) the amount you paid the Operator for the Service in the last 12 months (if any).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnity

You agree to indemnify and hold harmless the Operator from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any law or third-party rights

12. Suspension and Termination

The Operator may suspend or terminate access at any time (including immediately) to protect the beta, other testers, or the Operator, including for:

Suspected abuse or security risk
Violations of these Terms
Inactivity

Upon termination, your right to use the Service stops. You may request export/deletion of your data as described in the Privacy Policy.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.

Venue: If a dispute proceeds in court, it must be brought in state or federal courts located in California, unless prohibited by applicable law.

14. Changes

We may update these Terms. Continued use after changes means you accept the updated Terms. If changes are material, we will try to notify you via email or in-app/portal notice.
